How we collect, use, store and disclose personal information — and the choices you have.

1. About this policy
Nordmarq Property Pty Ltd (ABN 66 694 274 649), trading as Nordmarq Property and formerly operating as Kelly & Co Property (“Nordmarq”, “we”, “us” or “our”), is a commercial property firm providing property management, asset management, leasing and investment sales services. We are committed to handling personal information responsibly and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
This policy explains what personal information we collect, how we collect and use it, who we share it with, and how you can access or correct your information or make a complaint. It applies to our website at www.nordmarq.com.au, our campaign and landing pages, and the services we provide.
2. Personal information we collect
Depending on how you deal with us, we may collect:
- Contact details — your name, email address and phone number when you submit an enquiry, request a management review, subscribe to updates or otherwise contact us.
- Property information — details of properties you own, occupy or are interested in, including the property address you provide when requesting a management review or making a listing enquiry.
- Enquiry and correspondence content — messages you send us through website forms, email, phone or in person, and your stated preferences (such as property type or investment range).
- Client and transaction information — where we act for you or a related party, information reasonably necessary to provide our services, such as lease and tenancy details, ownership information, and financial and payment information relating to managed properties or transactions.
- Identity verification information — where the law requires it (for example under anti-money laundering and counter-terrorism financing legislation for certain property transactions), we may collect identification documents and related details.
- Website and campaign data — technical and usage information such as pages visited, device and browser type, and campaign attribution data that tells us how you found us (for example the advertising campaign, source or click identifiers appended to the link you followed).
You can deal with us anonymously or using a pseudonym where it is lawful and practicable to do so — for example when making a general enquiry — but we may not be able to provide our full services without your personal information.
3. How we collect it
We collect personal information:
- directly from you, when you complete a form on our website, email or call us, or deal with us in person;
- from property advertising portals and platforms through which you enquire about a property (for example realcommercial.com.au, CommercialReady, Domain or realestate.com.au);
- from third parties involved in a property matter, such as solicitors, valuers, referrers, co-agents or your authorised representatives; and
- from publicly available sources, such as title and company registers, where relevant to our services.
When you type a property address into an address field on our website, the partial address you type is sent to Google’s Places service so we can suggest matching Australian addresses. Google handles that query in accordance with its own privacy policy.
4. How we use your information
We use personal information to:
- respond to your enquiries and requests;
- provide our services, including property management, asset management, leasing and sales, and to administer leases, inspections, maintenance and reporting;
- facilitate property transactions and liaise with the parties involved;
- send you property alerts, market updates and marketing communications you have requested or would reasonably expect, each of which you can opt out of at any time;
- measure the effectiveness of our advertising campaigns and improve our website and services; and
- meet our legal and regulatory obligations, including under real estate, trust accounting and anti-money laundering laws.
5. Who we share it with
We do not sell personal information. We may disclose personal information to:
- our team members and related entities, on a need-to-know basis;
- service providers who support our business, such as website and database hosting, email delivery, customer relationship management, analytics and IT support providers, who are required to handle your information only for the purpose of providing their services to us;
- parties involved in a property matter where necessary to provide our services — for example owners, tenants, solicitors, valuers, financiers or contractors attending to repairs and maintenance;
- professional advisers such as lawyers, accountants and auditors; and
- government agencies, regulators or law enforcement where required or authorised by law.
Some of our service providers store or process information on servers located overseas, including in the United States. Where information is held overseas, we take reasonable steps to ensure it is protected to a standard consistent with the Australian Privacy Principles.
6. Marketing communications
We may send you marketing communications about properties, market insights and our services in accordance with the Spam Act 2003 (Cth). Every marketing email we send includes an unsubscribe link, and you can also opt out at any time by contacting us using the details below. We maintain a suppression list to ensure opt-outs are honoured.
7. Cookies and analytics
Our website uses cookies and similar technologies that are necessary for it to function. We use privacy-focused analytics to understand aggregate website usage — such as which pages are visited — rather than to build individual profiles. Where you arrive at our site from an advertising campaign, we may record campaign parameters and advertising click identifiers included in the link so we can measure campaign performance.
You can control or delete cookies through your browser settings. Disabling cookies may affect some website functionality.
8. Storage and security
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These steps include encrypted connections, access controls and reputable hosting providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Retention
We keep personal information for as long as it is needed for the purposes described in this policy or as required by law — including record-keeping obligations that apply to real estate agencies and trust accounting. When information is no longer required, we take reasonable steps to delete or de-identify it.
10. Access, correction and complaints
You may request access to, or correction of, the personal information we hold about you by contacting us using the details below. We will respond within a reasonable period. If we refuse a request, we will tell you why.
If you believe we have mishandled your personal information, please contact us first so we can investigate and respond. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
